UofW Law Speaker Series: Rethinking Copyright Institutions- The Future of Regulation in a Digital Era

In this lecture, several recent developments in copyright law in the U.S. and EU will be analyzed from an institutional perspective. The topic will be divided into three parts. First, the concept of institutional analysis in copyright law will be introduced and discussed, along with a basic overview of institutional choice theory and analysis. Second, current issues in copyright will be approached from an institutional perspective, with a specific focus on recent legal developments in the EU and U.S. Specifically, this part of the discussion will highlight current regulatory challenges inherent in the adoption of several new legal provisions under the 2019 EU Directive on Copyright in the Digital Single Market, as well as some aspects of recently proposed U.S. legislation on a small claims procedure for copyright disputes. Lastly, the idea of modifying current institutional arrangements in the regulation of copyright will be presented, including a proposal to create a new administrative actor at the EU level for addressing copyright-related legal issues.
Participants can expect to gain some basic knowledge of institutional choice theory and analysis, as well as some insights into the many different regulatory approaches adopted internationally in the field of copyright law.
